AC Wallace Creations LLC (“AC Wallace Creations,” “we,” “us,” or “our”) operates acwallace.com (the “Site”). This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have. It applies to the Site, our merchandise store, our membership program, our email newsletter, and our community spaces. By using the Site, you agree to the practices described in this policy.
1. Information We Collect
Information you provide to us
- Account information: name, email address, username, and password when you create an account or membership.
- Order information: name, billing and shipping address, email address, phone number (if provided), and details of the products you purchase.
- Payment information: payments are processed by third-party payment processors (see Section 3). We never see or store your full credit or debit card number. We receive only limited information such as the payment method type, the last four digits of your card, and confirmation that payment succeeded.
- Newsletter information: your email address and name (if provided) when you subscribe to our newsletter.
- Communications: the contents of messages you send us, such as customer service emails, contact form submissions, comments, and survey or voting responses.
Information collected automatically
- Usage and device information: IP address, browser type, device type, pages visited, referring pages, and dates and times of visits, collected through cookies and similar technologies and our hosting provider’s standard server logs.
- Cookies: small files stored on your device. We use cookies that are necessary for the Site to function (such as keeping items in your shopping cart and keeping you logged in), and may use analytics cookies to understand how visitors use the Site. See Section 6.
2. How We Use Your Information
- To process and fulfill merchandise orders, including sharing shipping details with our print-on-demand fulfillment partner.
- To create and manage your account and membership, including billing recurring subscriptions, granting access to members-only content, and applying member discounts.
- To send our newsletter and other communications you have signed up for. Every marketing email includes an unsubscribe link.
- To send transactional emails, such as order confirmations, shipping notifications, receipts, and membership renewal notices.
- To respond to your questions and provide customer support.
- To operate, maintain, secure, and improve the Site, and to prevent fraud and abuse.
- To comply with legal obligations, such as tax and accounting requirements.
We do not sell your personal information, and we do not share it with third parties for their own advertising purposes.
3. Who We Share Information With
We share personal information only with service providers who need it to help us run the Site and our business, and only for those purposes:
- Printful (print-on-demand fulfillment): receives your name, shipping address, email, and order details so your merchandise can be produced and shipped.
- WooPayments (powered by Stripe) and PayPal (payment processing): receive the payment details you enter at checkout. Their handling of your data is governed by their own privacy policies.
- MailerLite (email newsletter): stores subscriber email addresses and names and sends our newsletter on our behalf.
- Discord (community server): if you choose to join our Discord community, your participation is governed by Discord’s privacy policy. Our integration may link your Site membership to your Discord account to assign member roles.
- Bluehost (website hosting and email): hosts the Site and our business email, and processes standard server logs.
We may also disclose information if required by law, court order, or governmental request; to protect our rights, safety, or property or those of others; or in connection with a sale, merger, or reorganization of our business, in which case this policy will continue to apply to your information until updated.
4. How Long We Keep Information
We keep personal information only as long as needed for the purposes described above. Order and payment records are retained as required for tax, accounting, and legal purposes. Account information is kept while your account is active. Newsletter information is kept until you unsubscribe. You may request deletion of your information as described in Sections 7 and 8.
5. How We Protect Information
The Site uses SSL/TLS encryption for data transmitted between your browser and our server. Payment card data is handled entirely by our PCI-compliant payment processors. We limit access to personal information to those who need it to operate the business. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
6. Cookies & Analytics
You can control or delete cookies through your browser settings. Blocking necessary cookies may prevent parts of the Site, such as the shopping cart, checkout, and member login, from working. If we use analytics tools, they collect aggregated information about Site traffic and usage to help us understand what content visitors enjoy; this information is not used to identify you personally.
7. Your Choices & Rights
- Email: Unsubscribe from our newsletter at any time using the link in any marketing email. You will still receive transactional emails about your orders and membership.
- Account: you can review and update your account information by logging into your account on the Site.
- Access, correction, and deletion: you may request a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it (subject to records we must keep by law) by emailing sales@acwallace.com.
Depending on where you live, you may have additional rights under your state’s or country’s privacy laws, as described below. We honor valid requests regardless of where you live whenever we reasonably can.
United States state privacy rights
If you live in California or another state with a comprehensive consumer privacy law, you may have rights to know what personal information we collect, to access or delete it, to correct inaccuracies, and to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under those laws. We will not discriminate against you for exercising any privacy right. To make a request, email us at the address below; we may need to verify your identity before responding.
Visitors from the EU, UK, and other regions
If you are located in the European Economic Area, the United Kingdom, or another region with data protection laws, we process your personal information on the following legal bases: performance of a contract (fulfilling orders and memberships), legitimate interests (operating and improving the Site and preventing fraud), consent (newsletter marketing), and legal obligation (tax and accounting records). You have rights of access, rectification, erasure, restriction, portability, and objection, and the right to withdraw consent at any time, as well as the right to lodge a complaint with your local supervisory authority. Our Site and service providers are based in the United States, so your information will be transferred to and processed in the United States.
8. Children’s Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Purchases and paid memberships are limited to adults. If you believe a child under 13 has provided us personal information, please contact us at sales@acwallace.com and we will delete it.
9. Do Not Track
Some browsers offer a “Do Not Track” signal. Because there is no common standard for interpreting these signals, the Site does not currently respond to them.
10. Changes to This Policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top reflects the most recent version. Material changes will be posted on the Site, and where appropriate, we will notify you by email.
