Welcome to acwallace.com (the “Site”), owned and operated by AC Wallace Creations LLC (“AC Wallace Creations,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site, including our blog, webcomic, merchandise store, membership program, newsletter, and any community spaces we operate, including our Discord server. By accessing or using the Site, creating an account, purchasing merchandise, or subscribing to a membership, you agree to be bound by these Terms, our Privacy Policy, and our Purchase, Shipping & Return Policy, each of which is incorporated by reference. If you do not agree to these Terms, please do not use the Site.

1. Eligibility

You must be at least 13 years old to use the Site. You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase or hold a paid membership. If you are under 18, a parent or legal guardian must make any purchase on your behalf and is responsible for the account. By using the Site, you represent that you meet these requirements.

2. Accounts

Some features of the Site, including memberships and order history, require an account. You agree to provide accurate information when creating an account, to keep your login credentials confidential, and to notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account. Accounts and memberships are personal to you and may not be shared, sold, or transferred. Sharing your login credentials to give others access to members-only content is a violation of these Terms and may result in suspension or termination of your account without refund.

3. Memberships & Subscriptions

Billing

We offer paid membership tiers billed on a recurring monthly basis through our payment processors. By subscribing, you authorize us to charge your selected payment method the applicable membership fee for each billing cycle until you cancel. Membership prices and tier benefits are described on the Site and may change from time to time; we will give existing subscribers reasonable advance notice of any price change, which will take effect at the start of a subsequent billing cycle.

Cancellation

You may cancel your membership at any time through your account page on the Site. Cancellation takes effect at the end of your current billing period. You will retain access to members-only content and benefits until that date. We do not provide refunds or credits for partial billing periods, except where required by law.

Member benefits

Membership benefits, such as members-only content, early access, merchandise discounts, voting on story development, and access to community spaces, are provided as described for each tier at the time of purchase. Benefits are for your personal, non-commercial enjoyment only. We may modify, add, or retire specific benefits over time; if we materially reduce the benefits of your tier, you may cancel as described above.

4. Purchases

All merchandise purchases are governed by our Purchase, Shipping & Return Policy, available on the Site. All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to correct pricing errors, to limit quantities, and to refuse or cancel any order, including orders we suspect are fraudulent, with a full refund of any amount paid.

5. Intellectual Property

All content on the Site is the property of AC Wallace Creations LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. This includes, without limitation: our books, novels, and short stories; the webcomic “Bows, Books & Bolts” and its characters, artwork, and storylines; all blog posts, newsletters, and members-only content; product designs and artwork appearing on merchandise; and the AC Wallace Creations name, logos, and taglines.

You may not copy, reproduce, distribute, republish, display, post, transmit, adapt, or create derivative works from any Site content without our prior written permission, except as expressly allowed below. Purchasing merchandise or holding a membership grants you no ownership of, or license to, any underlying intellectual property.

What you may do

  • View, read, and enjoy Site content for your personal, non-commercial use.
  • Share links to public pages of the Site on social media or elsewhere.
  • Quote brief excerpts of public content with attribution and a link back to the Site, consistent with fair use.

What you may not do

  • Copy, screenshot, download, or redistribute members-only content, including sharing it with non-members.
  • Use our characters, artwork, designs, or text on products, websites, or services of your own, commercial or otherwise, without written permission.
  • Use any Site content to train artificial intelligence or machine learning models, or scrape, harvest, or systematically extract content from the Site.

6. Community Conduct

We want our comment sections, member spaces, and Discord server to be welcoming places. When participating in any community space we operate, you agree not to:

  • Post content that is unlawful, harassing, hateful, threatening, defamatory, obscene, or invasive of another person’s privacy.
  • Spam, advertise, or promote other products or services without our permission.
  • Impersonate any person, including us or other members.
  • Share pirated copies of our works or anyone else’s, or links to them.
  • Post spoilers of members-only content in public spaces or share members-only material outside member areas.
  • Attempt to disrupt, hack, overload, or interfere with the operation of the Site or our community spaces.

We may remove content and suspend or ban any user from our community spaces or the Site, at our discretion, for conduct that violates these Terms or that we reasonably believe is harmful to our community. Our Discord server is also governed by Discord’s own Terms of Service and Community Guidelines.

7. User Submissions

If you post comments, participate in story voting, send us feedback, or otherwise submit content or ideas to us (“Submissions”), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and incorporate those Submissions in connection with operating and promoting the Site and our works. You represent that your Submissions are your own and do not infringe anyone else’s rights. We are under no obligation to use, publish, or compensate you for any Submission. Please do not send us unsolicited story manuscripts or detailed creative pitches; if you do, you agree we owe you no obligation of confidentiality or compensation, and that similarities between your Submission and our future works do not create any claim against us.

8. Copyright Complaints (DMCA)

We respect the intellectual property of others. If you believe content on the Site infringes your copyright, please send a notice to sales@acwallace.com with: (a) identification of the copyrighted work; (b) the URL or location of the allegedly infringing material; (c) your name, address, email, and phone number; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and (f) your physical or electronic signature. We will respond to valid notices consistent with the Digital Millennium Copyright Act.

9. Third-Party Services & Links

The Site uses third-party services, including payment processors, a print-on-demand fulfillment partner, an email newsletter provider, and Discord, and may contain links to third-party websites, including retailers where our books are sold. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms and privacy policies.

10. Disclaimers

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN OUR PURCHASE, SHIPPING & RETURN POLICY OR AS REQUIRED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AC WALLACE CREATIONS LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, MEMBERSHIPS, OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless AC Wallace Creations LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your Submissions, or your misuse of the Site.

13. Termination

We may suspend or terminate your account or access to the Site at any time for violation of these Terms. You may stop using the Site and cancel any membership at any time. Sections of these Terms that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent version. Material changes will be posted on the Site, and for paid members we will provide notice by email or through the Site. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site will be resolved in the state or federal courts located in New Mexico, and you consent to personal jurisdiction and venue there. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your place of residence.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy and the Purchase, Shipping & Return Policy, are the entire agreement between you and us regarding the Site.
